What is a Stay of Execution

Request a Stay of Execution.

In some cases, the debtor has the right to request a stay of execution. A person who wishes to apply for this type of application in debt enforcement must apply with a written petition for the stay of execution. The court has the right to demand collateral for the stay of execution if it deems it necessary. The relevant law article regarding the stay of execution is as follows:

A Stay of Execution Can Be Requested.

“ARTICLE 381 - (1) An action for annulment of judgment does not stay the execution of the judgment. However, if a stay of execution is deemed necessary due to the nature of the action or judgment and other circumstances, the court examining the request for annulment may grant a stay of execution on the condition that the person requesting the annulment provides collateral. If the reason for annulment is based on a court decision, collateral will not be requested in this case.”
