What Should Undocumented Foreigners Do?
Foreigners may be in a situation where they cannot obtain a residence permit in Turkey, either because their period of stay has expired or their permit has ended. Individuals whose visas have expired are first brought to the Kumkapı foreign reception center. After undocumented foreigners are deported, they may be banned from entering the country for at least 5 months or up to 5 years. Foreigners who are banned from entering the country must be apprehended within the country. However, foreigners who leave the country of their own volition are not given an entry ban. If individuals who leave the country voluntarily re-enter within 90 days, no penalty is applied. Foreigners who voluntarily present themselves at a border gate within 10 days are not subject to prohibitions such as residence permits or
work permits for foreigners. The Directorate General of Migration Management requests documents such as the original and photocopy of the passport, the original and photocopy of the marriage certificate, and a criminal record from foreigners residing in our country due to marriage. Foreigners must obtain a criminal record from the Turkish consulate in their home country, bearing an apostille seal. For both the foreigner and their spouse, who is a citizen of the Republic of Turkey, to benefit from private health insurance, it is necessary for the spouse to not have any existing insurance.
How to Obtain a Residence Permit for Foreigners
Those who enter Turkey without obtaining any visa and wish to reside in our country for a long period are obliged to obtain a residence permit, also known as an iqama permit. While the tourist residence permit is for 1 year, foreigners also have the right to obtain a 6-month tourist permit. Different documents are required from foreigners based on their reasons for residence in our country, such as marriage, study, or tourism. Work permits for foreigners and residence permits are issued by the Directorate General of Migration Management. Documents such as a valid mobile phone number, general health insurance, 4 passport-sized photographs, a photocopy of the passport, and the original passport are required. Additionally, if the foreign individual will be staying with a Turkish citizen, a notarized undertaking from that individual is necessary. To enable foreigners in our country to reside in any city they wish and to work in any job they choose, a work permit must be granted by the TC Ministry of Labor and Social Security. Furthermore, foreigners residing abroad must apply to TC consulates to obtain a work permit.
